TERRAIN TINKER is A registered trading name for TERRAIN TINKER LIMITED

‘You can print these files for you own personal use but you may not sell the printed items or distribute the digital 3D models‘

IMPORTANT – PLEASE READ THESE TERMS OF USE CAREFULLY. THE SITE IS A COPYRIGHTED WORK BELONGING TO TERRAIN TINKER. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND TERRAIN TINKER FOR THE USE OF THE SITE, SERVICES AND STL FILES. BY ACCESSING OR USING THE SITE YOU ARE ACCEPTING THESE TERMS OF USE (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT) AND YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THESE TERMS OF USE (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT). IF YOU DO NOT AGREE WITH ALL OF THE PROVISIONS OF THESE TERMS OF USE, DO NOT ACCESS OR USE THE SITE.

By accessing or using our Site or downloading our STL files, you agree to the terms below; if you don’t agree, don’t use the Site.

1 License. Subject to these Terms of Use, TERRAIN TINKER grants you a non-transferable, non-exclusive, license to use the Site and STL Files for your personal, non-commercial use

2 Certain Restrictions. The rights granted to you in these Terms of Use are subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site, Services or materials you print under this license; (b) you shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site or STL Files; (c) you shall not access the Site or Services or STL files in order to build a similar or competitive service; and (d) except as expressly stated herein, no part of the Site or Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means..

3 Modification. TERRAIN TINKER reserves the right, at any time, to modify, suspend, or discontinue the Site or Services or any part thereof with or without notice. You agree that TERRAIN TINKER will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Site or Services or any part thereof, except and if otherwise expressly set forth in Section 8.

Any future release, update, or other addition to functionality of the Site or Services shall be subject to the terms of these Terms of Use. All copyright and other proprietary notices on any Site or Services content must be retained on all copies thereof.

TERRAIN TINKER reserves the right to change these terms and conditions at any time.

4 No Support or Maintenance. You acknowledge and agree that TERRAIN TINKER will have no obligation to provide you with any support or maintenance in connection with the Site or Services or STL Files.

5 Ownership. Excluding your User Content (defined below), you acknowledge that all the intellectual property rights, including copyrights, patents, trade marks, and trade secrets, STL Files in the Site are owned by TERRAIN TINKER or TERRAIN TINKER’s licensors. The provision of the Site and STL files does not transfer to you or any third party any rights, title or interest in or to such intellectual property rights. TERRAIN TINKER and its suppliers reserve all rights not granted in these Terms of Use.

6 Guarantees or warranties. Other than any obligations under the New Zealand Consumer Guarantees Act 1993, TERRAIN TINKER will not be liable in respect of any loss or damage, including special, consequential or indirect loss or damage however arising in relation to your use of the Site or STL files.

7 Communication and privacy. We may collect and process data about you, including data provided by you by filling in forms on our Site, and details as a result of your visits to our Site.

By using our Site you expressly consent to us collecting that information.

We will use your data to a) process any purchases made by you; b) To ensure that content from our site is presented in the most effective manner for you and for your computer; c) To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes; d) To allow you to participate in interactive features of our service, when you choose to do so; and e) to permit selected third parties to use your data, to provide you with information about goods and services which may be of interest to you and you agree that we or they may contact you about these from time to time.

8 Disputes. We will do our best to resolve any disputes with you, however if we cannot we both agree that disputes will be resolved by arbitration within New Zealand.
